Knowledgeable Attorneys for Uncontested Divorces in Rockville, Maryland

Not all divorces end with dramatic courtroom disputes. When spouses are in agreement about how a divorce should be handled, the process ends up much easier for all parties involved. During an uncontested divorce, it is highly advisable to seek legal guidance from a professional to keep the process moving smoothly.

At Salvado Law Offices, our Rockville family law attorneys can help you reach an ideal settlement through an uncontested divorce. Our firm was founded over 25 years ago, and in that time, we have helped numerous clients in uncontested divorce cases, standing up for their rights and interests through skilled negotiation.

What Are the Benefits of Uncontested Divorce?

One of the first and most obvious benefits of uncontested divorces is the lack of conflict. These divorces tend to be less stressful than contested divorces, which may involve intense litigation and emotional arguments. This kind of amicable resolution can also help to reduce your child's anxiety in a custody case.

Another benefit of an uncontested divorce is the comparatively lower costs. An uncontested divorce can be completed with minimal involvement of the courts, saving you money from avoidable litigation. Avoiding litigation also means that you can resolve your divorce faster, sometimes in a matter of months.

At Salvado Law Offices, we can go over your case and discuss the feasibility of getting an uncontested divorce. If there are any obstacles in the way of an uncontested divorce, we will work closely with you and your spouse to help you overcome them outside of court.

Questions?

Find clear answers to common concerns about divorce and other family law matters.

What Are the Grounds for Divorce in Maryland?

There are three different grounds for divorce that you can bring forward in Maryland:

  • Six months of living separate and apart (even if you live in the same household)
  • Irreconcilable differences between you and your spouse that cannot be resolved
  • Mutual consent

Out of these options, mutual consent is the most conducive to an uncontested divorce. If you decide to pursue a divorce on these grounds, you and your spouse will have to sign a document known as a marital settlement agreement detailing how you will address all concerns related to the division of property, alimony, child custody, and child support.

Our lawyers can assist you in filing Form CC-DR-116 to file for an uncontested divorce. We can review the terms of your settlement agreement to make sure that your best interests are protected, and if any issues become apparent, we can suggest appropriate revisions.

What if Disagreements Come Up During an Uncontested Divorce?

A divorce that starts out uncontested can become more complicated if you and your spouse disagree about certain terms. However, you do not have to go to court just to resolve a disagreement. At Salvado Law Offices, we can help you explore options for alternative dispute resolution to keep the cost of your divorce down.

Many spouses turn to mediation to resolve a contested divorce without the need for litigation. A certified mediator can help you and your spouse reach an agreement outside of court, proposing solutions and looking for possible points of compromise. Mediation ends when both parties resolve their differences and decide to settle.

If the structure of mediation does not appeal to you, collaborative law is another option to resolve your divorce outside of court. In collaborative law, you and your spouse will work together with your attorneys and other divorce professionals to come to an agreement.

At Salvado Law Offices, we are here to uphold your parental rights while advocating for a healthy solution for your child's upbringing.
